Introduction
Consumers in India have the right to file a complaint when they encounter issues like defective products, bad services, overcharging, unfair trade practices, or any other violation of their consumer rights. These complaints can be directed to various consumer forums and organisations, such as the National Consumer Disputes Redressal Commission (NCDRC), State Consumer Disputes Redressal Commissions, and District Consumer Disputes Redressal Forums.
Steps for Filing a Consumer Complaint
- Gather necessary documents: Collect all relevant documents related to the purchase or service in question. This may include bills, receipts, warranty cards, agreements, correspondence, and any other evidence supporting your complaint.
- Send a legal notice: Before filing a consumer complaint, it is generally advisable to send a legal notice to the opposite party (seller, service provider, etc.) stating your grievance, the relief sought, and a reasonable deadline for resolving the issue. This notice serves as a formal communication and provides an opportunity for the opposite party to address your complaint before escalating the matter further.
- Identify the appropriate Consumer Forum: Depending on the value of your claim, you need to identify the appropriate Consumer Forum to file your complaint. There are three levels of Consumer Forums in India:
District Consumer Disputes Redressal Forum (District Forum), State Consumer Disputes Redressal Commission (State Commission), and the National Consumer Disputes Redressal Commission (National Commission). Jurisdiction is determined by the value of the claim and the location of the opposite party’s office or residence. - Draft and file the complaint: Prepare a clear and concise complaint stating the facts of the case, the relief sought, and the amount of compensation claimed. You can engage the services of a lawyer or draft the complaint yourself. The complaint should be filed within the prescribed time limit, generally within two years from the date of the incident or when the cause of action arose.
- Pay the required fee: Each Consumer Forum has a prescribed fee structure for filing a complaint. Make sure to pay the required fee along with the complaint. Fee amounts vary depending on the value of the claim.
- Attend the hearings: After filing the complaint, you will receive a notice of hearing from the Consumer Forum. Attend all scheduled hearings and present your case, along with any supporting evidence or witnesses, before the Forum. The opposite party will also have an opportunity to present their defence.
- Get a decision: The Consumer Forum will examine all the evidence and arguments presented by both parties and pass a judgement. If the decision is in your favour, the opposite party will be directed to provide the relief sought.
